These Terms and Conditions govern your use of the Xibalba Divers MX website and any enquiries, bookings, courses, dives, and related services provided by Xibalba Divers MX.

By using our website, submitting a booking request, or participating in any activity, you agree to these Terms.

1. Definitions

“Company”, “we”, “us”, “our” means Xibalba Divers MX.
“You”, “guest”, “customer”, “diver” means the person using the website or booking services.
“Services” means dives, courses, trips, rentals, guiding, and any related experiences.

2. Website use and enquiries

Our website may include contact forms, booking request forms, WhatsApp links, embedded videos, and informational pages. Submitting a booking request is a request for availability and does not guarantee a confirmed booking until we confirm details with you.

3. Eligibility and participation requirements

You are responsible for meeting the requirements for the activity you book, including certification level, experience, and age requirements.

For certified dives, you must present a valid certification card or proof of certification when requested. If you cannot provide the required proof, we may refuse service or offer an alternative option when possible.

You must follow all briefings, safety instructions, and guide or instructor directions at all times.

4. Medical fitness and safety

Scuba diving and related activities involve inherent risks. You agree that you are medically fit to participate and that you will answer any required medical questionnaires honestly.

If a medical certificate is required for your activity or your responses indicate it is needed, you agree to provide it before participating. We may refuse participation if safety requirements are not met.

5. Risk acknowledgement and liability waiver

You understand that scuba diving, boat travel, and water activities carry risks that may include serious injury or death.

Before participating, you may be required to sign an assumption of risk and liability waiver used by us or by a partner operator. Refusal to sign required documentation may result in cancellation of participation.

Nothing in these Terms limits any liability that cannot be excluded under applicable law.

6. Booking confirmations

A booking is confirmed only when we confirm it in writing by email or WhatsApp, or when you receive an official confirmation message from us.

We may ask for key details to confirm a booking, including number of divers, highest certification, number of logged dives, date of last dive, and preferred dates.

For safety and quality, we may limit group sizes. If your group is larger than our standard limit, we may split the group, schedule separate times, or propose an alternative plan.

7. Pricing, deposits, and payment

Prices may be shown on the website or provided by message. Prices may vary based on location, seasonal conditions, entrance fees, or logistics.

If a deposit or full prepayment is required, we will tell you the amount, the due date, and what it covers before you pay.

Unless explicitly stated otherwise, learning materials, park fees, or specialty add ons may not be included for certain courses or experiences.

8. Cancellations, rescheduling, and no shows

If you need to change your booking, contact us as soon as possible. We will do our best to reschedule based on availability.

If you do not show up, arrive late, or miss the departure time, you may forfeit the booking and any payments made because boats, guides, and permits may still be reserved.

9. Weather, sea conditions, and operational changes

Ocean and weather conditions can change quickly. We may adjust dive sites, schedules, or logistics for safety or operational reasons.

If conditions are not suitable, we may reschedule, offer an alternative experience, or cancel the activity. Any refund or credit, if applicable, will be communicated clearly and handled fairly.

10. Refund policy

All sales are final and no refunds are provided, except where required by applicable law or where we explicitly agree in writing to a refund.

In some cases, we may offer a reschedule or a credit at our discretion, especially for weather related changes or safety decisions.

11. Third party services and partner operators

Some trips may involve third party boats, parks, transport providers, or partner operators. In those cases, additional terms may apply, including park rules and operator documentation. You agree to comply with those requirements.

12. Equipment use and responsibility

If rental equipment is included or provided, you agree to use it responsibly and follow fitting and usage guidance.

You may be responsible for loss or damage caused by misuse or negligence.

13. Photos, video, and marketing

We may take photos or video during activities for operational or promotional purposes. If you prefer not to appear in marketing content, tell us in writing before the activity and we will respect your request where reasonably possible.

14. Intellectual property

Website content including text, photos, logos, and branding is owned by or licensed to Xibalba Divers MX and may not be copied, reused, or redistributed without permission.

15. Privacy

Our handling of personal data is explained in our Privacy Policy. By using our website or submitting information, you agree to our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time. The latest version will be posted on the website with an updated effective date.

17. Governing law and jurisdiction

These Terms are governed by the laws of Quintana Roo and applicable federal laws of Mexico. Any disputes will be handled by the competent courts in Quintana Roo, Mexico, unless mandatory consumer protection rules require otherwise.
